REED CITY\u00a0 \u2014 A sex offender who failed to register under the Sex Offender Registration Act and then re-offended was sentenced to up to 15 years in prison last week in Osceola County's 49th Circuit Court. Michael Lee Lamphere, 46, was charged in September with one count of failure to register as a sex offender and one count of spending time in a student safety zone at an Evart school. Although,\u00a0Lamphere\u2019s registered address was in Marion, he appears to have been living in Evart. Soon after the initial charges, a victim came forward with allegations of sexual abuse that occurred around March 1 in Evart.\u00a0Lamphere was then charged with two counts of second-degree criminal sexual conduct involving a victim under the age of 13 and one count of fourth-degree criminal sexual conduct. His bond was set at $1 million. According to court documents, on Feb. 20, Lamphere and the Osceola County Prosecutor's Office reached plea agreements for both cases and the defendant was sentenced the same day. In the first case, Lamphere pleaded guilty to failure to register as a sex offender, while the charge of being in a student safety zone was dismissed as part of the plea deal. He was sentenced to a minimum of 13 months to a maximum of four years in prison. In the second case, he pleaded guilty to one count of second-degree CSC and one count of fourth-degree CSC. In exchange for his plea, the prosecutor's office dismissed one of the second-degree CSC charges, as well as Lamphere's charge for being a habitual offender, which stems from prior convictions. He was convicted of one count of fourth-degree criminal sexual conduct in July 1993 and in 2002, he was convicted for failure to report as a sex offender. He was sentenced to a minimum of 19 months and a maximum of 15 years in prison for the second-degree CSC charge and a minimum of 13 months and maximum of two years for the fourth-degree CSC charge. All three of those sentences are concurrent. He was given credit for 152 days already served. Under the Sex Offender Registration Act, Lamphere must register as sex offender for life.
