ROSE LAKE TWP.  — Two suspects attempting to steal marijuana plants early Monday morning from a garage in Rose Lake Township were shot by the homeowner.

The Osceola County Sheriff's Office was alerted about the incident by staff of Munson Healthcare Cadillac Hospital, where the two shooting victims went for treatment of their injuries. Deputies responded to the hospital to speak with the victims.

The incident reportedly occurred at about 4 a.m. at a residence on 15 Mile Road near 130th Avenue. The investigation indicates the two victims/suspect were breaking and entering into a marijuana grow operation located in the homeowner’s unattached garage. While removing the plants, it appears the homeowner confronted them and shot the two suspects, reportedly with a shotgun.

However, law enforcement officials only have one side of the story because they have been unable to speak with the homeowner, said Osceola County Undersheriff Justin Halladay.

"We haven’t been able to make contact with the homeowner at this time," Halladay said. "The scene has been processed because it is a crime scene, but the homeowner has not made themself available to us yet."

Police still would like to know about the circumstances leading up to the shooting and what took place from the homeowners perspective, Halladay said.

Because the homeowner has not spoken with police, it is not clear if the marijuana grow operation is legal or not.

"We haven't been able to determine that yet," Halladay said. "We don't know if this person has a medical marijuana card and if this operation is permitted or not."

One victim was treated and released from the hospital, but the second victim was transported to Munson Medical in Traverse City to receive further treatment for injuries received.

The suspect/victim who was treated and released from the hospital was arrested on home invasion charges and is lodged at the Osceola County Jail. Charges will be sought for the second suspect.

This incident remains under investigation.
